1. data processing in connection with mandating:

When you mandate us, we collect the following information, among others:

  • Title, first name, surname,
  • a valid e-mail address,
  • address,
  • telephone number (landline and/or mobile)
  • Information that is necessary for the assertion and defence of your rights within the scope of the mandate

This data is collected

  • to be able to identify you as our client;
  • to be able to provide you with appropriate legal advice and representation
  • for correspondence with you;
  • for invoicing purposes;
  • to process any existing liability claims and to assert any claims against you;

The data processing is carried out at your request and is required in accordance with Swiss and European data protection regulations for the purposes mentioned for the appropriate processing of the mandate and for the mutual fulfilment of obligations arising from the mandate agreement.

2. data processing in connection with recruitment:

WWVG collects, stores and processes the following data from its applicants:

  • First name and surname
  • date of birth
  • address
  • curriculum vitae
  • School, university and work references
  • Reference information
  • Other application documents submitted by the applicant.

By applying to WWVG, you give your express consent to the processing of this personal data. Your data will be processed for the purpose of carrying out the application process and also to fulfil legal obligations. WWVG will not process the data provided for purposes other than the application process.

3 Data processing in connection with visits to our website

During your visit to the WWVG website, information of a general nature (e.g. the date of your visit, the type of web browser, your IP address, the operating system used and the domain name of your Internet service provider) is automatically collected. WWVG uses this data for administration purposes and to ensure the functionality of the website. This data is required to correctly deliver and optimise the content of our website, to ensure the long-term functionality of our information technology systems and the technology of our website and to provide law enforcement authorities with the information necessary for criminal prosecution in the event of a cyber attack. It is not possible for WWVG to draw any conclusions about your person based on this information.

4. transfer of data to third parties

Your personal data will not be transferred to third parties for purposes other than those listed below.

This includes in particular the disclosure to opposing parties and their representatives (in particular their lawyers) as well as courts and other public authorities for the purpose of correspondence and for the assertion and defence of your rights. The attorney-client privilege remains unaffected. Insofar as data is concerned that is subject to attorney-client privilege, it will only be passed on to third parties in consultation with you.

In addition, WWVG will appoint processors for hosting, maintenance, administration and storage (e.g. backup and/or cloud storage) of your personal data, which process personal data to the extent necessary for the performance of such hosting, maintenance, administration and backup measures and/or similar purposes. In this context, some of your personal data may be stored outside Switzerland and the European Union. If WWVG stores Personal Data outside Switzerland or the European Union, WWVG will take all reasonable steps required by applicable data protection law to ensure that your Personal Data is treated as safely and securely as in Switzerland or within the European Union.

5. storage

The personal data collected by us for the mandate will be stored until the expiry of the statutory retention period for lawyers (10 years) and then deleted, unless we are obliged to store it for a longer period due to other statutory retention and documentation obligations or you have consented to storage beyond this (e.g. in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR).

If required by the applicable data protection regulations, your personal data will be deleted as soon as it is no longer required for the purpose of the processing for which it was collected. The storage of your personal data in accordance with the statutory retention and documentation obligations is always reserved.

6. rights of data subjects

You have the right to

  • To withdraw the consent you have given us at any time. As a result, we will no longer continue the data processing that was based on this consent in the future;
  • to request information about your personal data processed by us. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information about its details;
  • to demand the immediate correction of incorrect or incomplete personal data stored by us
  • to request the erasure of your personal data stored by us, unless the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation (e.g. retention obligation for lawyers), for reasons of public interest or for the establishment, exercise or defence of legal claims
  • to demand the restriction of the processing of your personal data if the accuracy of the data is disputed by you, the processing is unlawful, but you refuse to delete it and we no longer need the data, but you need it for the assertion, exercise or defence of legal claims or you have lodged an objection to the processing;
  • to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transmitted to another controller.

7 Security and liability

WWVG takes appropriate measures to protect personal data against loss, misuse, unauthorised access, disclosure, alteration or destruction. To this end, WWVG uses suitable technical and organisational security measures that are continuously improved in line with technological developments. However, WWVG cannot guarantee the absolute security of the data.

8. final provisions

WWVG reserves the right to change the content of this privacy policy at any time and without notice. It is therefore recommended that you consult this privacy policy regularly.

Should one or more provisions or parts of this privacy policy be or become invalid or void, this shall not affect the validity of the remaining provisions. In the event of the invalidity or nullity of a provision, it shall be replaced by a valid provision that comes as close as possible to the purpose of the invalid or null and void provision against which this data protection declaration violates.

Subject to any mandatory applicable data protection laws, this Privacy Policy is governed by Swiss substantive law, excluding the conflict of laws rules of the Swiss Federal Act on Private International Law. The exclusive place of jurisdiction is St. Gallen, Switzerland, subject to any (additional) foreign places of jurisdiction that apply under mandatory foreign law.
